Services Provided: The Customer hereby requests and DAMTWO, Inc. agrees to provide outdoor mosquito and pest control services from the date of this contract. The service shall be provided approximately every 21-30 days, depending on weather conditions, on a date mutually agreed upon by Customer and DAMTWO, Inc. If additional service is deemed necessary by either the Customer or DAMTWO, Inc then at no charge an additional service date will be chosen.
Term: The initial term of this contract is for the 2022 season. After the first season, this agreement will automatically renew. Either party may cancel the contract by providing the other party with 5 days written notice. Dads Against Mosquitoes reserves the right after the first year to increase the charge for regular service.
Service Exclusion and Waiver: Customer understands that this contract does not include the control or prevention of wood infesting organisms such as termites, powder post beetles, wood borers, carpenter ants or bees, wood wasps, or wood decay fungus. Customer further understands that this contract does not include treatment for any mold conditions which is outside the scope of this contract.
Customer expressly waives and releases DAMTWO, Inc. from liability for any claim for personal injury including but not limited to illness such as West Nile Virus, insect bites and stings caused by outdoor mosquitoes or pests. Customer waives any claim for damage or injury unless made in writing within one year of the occurrence. In no event will DAMTWO be responsible for consequential damages or loss of use of property DAMTWO, Inc. will use its best efforts and the safest most effective products to eliminate outdoor mosquitoes and pests. However, DAMTWO, Inc. cannot guarantee against re-infestation of mosquitoes or pests from migratory patterns or neighboring areas nor does DAMTWO, Inc. guarantee against complete elimination of outdoor mosquitoes or pests. DAMTWO, Inc. will as stated above return to the Customer address outside the regularly scheduled service date and reapply the necessary treatment. DAMTWO is not responsible for loss of product due to extreme weather conditions.
Chemical Information Warning: The customer is hereby informed that virtually all pesticides have some odor which may be present for a period of time after the application if you or any other member of household believes you have sensitivities to chemical odors or chemicals then Dads Against Mosquitoes recommends that you contact your physician. At the customers request Dads Against Mosquitoes will provide information about the chemicals to be used in treating the yard.
I HAVE READ AND UNDERSTAND THE TERMS OF THIS CONTRACT AND FURTHER UNDERSTAND THAT THERE ARE NO OTHER TERMS OR PROVISIONS WHICH APPLY OTHER THAN THOSE PRINTED HEREIN.
